Legislation in the 118th Congress (2023-24)
FairVote supported several pieces of RCV legislation in the 118th United States Congress. Those bills are listed below.
The Fair Representation Act would implement proportional RCV for U.S. House of Representatives elections. The version of the bill in the 118th Congress included multi-member districts, ranked choice voting, and new requirements for congressional redistricting. The act was numbered H.R.7740 in the House.
The Voter Choice Act would provide federal grants to support the cost of local and state governments transitioning to RCV and/or proportional RCV. The act was numbered H.R.8462 in the House and S.3313 in the Senate.
The Ranked Choice Voting Act would would institute RCV for all primary and general elections for the U.S. House and Senate beginning in 2028. The act was numbered H.R.9578 in the House and S.5048 in the Senate.
Legislation in the 117th Congress (2021-22)
The 117th United States Congress advanced RCV with multiple pieces of legislation, including in bills that passed the U.S. House of Representatives.
The Fair Representation Act would implement proportional RCV for U.S. House of Representatives elections. The version of the bill in the 117th Congress included multi-member districts, ranked choice voting, and independent redistricting commissions with RCV for elections for U.S. Senate and single-winner House seats. It was sent to the House Administration and Judiciary committees.
The Voter Choice Act would provide federal grants to support the cost of local and state governments transitioning to RCV and/or proportional RCV. It was successfully offered as an amendment to the Protecting Our Democracy Act, which passed the House in December 2021.
The Freedom to Vote Act included the administration of RCV as an eligible activity for funding within the act’s State Democracy Promotion Program. The bill passed the House in January 2022 before failing to overcome a filibuster in the Senate.
The For the People Act included two pro-RCV provisions: one that would have required all new voting equipment purchased with federal dollars to be compatible with RCV elections and one to create a GAO study about RCV. The bill passed the House in March 2021.
The Congress Commission Act would have established a commission to make recommendations on the size of the U.S. House of Representatives and the potential of electing the House of Representatives with a proportional voting system. The bill was sent to the House Subcommittee on the Constitution, Civil Rights, and Civil Liberties.
